These General Terms and Conditions apply to purchases made through o-tonkeramik.com from O-TON Keramik.

2. Products and handmade variation
We describe the essential characteristics of each product on its product page. Images are illustrative and screen settings can affect colour. Small differences in glaze, colour, dimensions, surface and motif placement are characteristic of ceramic production and are not defects where the product remains consistent with its description and agreed quality.
3. Personalised products
You are responsible for checking personalisation details before ordering. We may contact you if an instruction is unclear. A personalised order cannot usually be changed after production begins. Statutory cancellation rules for goods made to an individual choice are explained in our Returns & Right of Withdrawal page.
4. Ordering and contract formation
Product listings are invitations to submit an order. By completing checkout, you submit a binding offer to purchase the goods in your cart. An automated order acknowledgement confirms receipt but does not necessarily constitute acceptance. The contract is accepted when we send an acceptance or dispatch confirmation, take the action that clearly fulfils the order, or otherwise expressly accept it. We may decline an order for legitimate reasons such as unavailability, an obvious pricing error, failed payment or an instruction we cannot safely fulfil.
5. Prices, taxes and payment
Prices and any applicable taxes are shown before you place the order. Available payment methods appear at checkout. Payment is due when the order is placed unless checkout states otherwise. The currency selected or displayed by the store at checkout governs the transaction.
6. Delivery
Preparation and delivery estimates are described in our Shipping Policy and on the relevant product page. A specific estimate for a made-to-order piece takes priority over a general estimate. Risk of accidental loss transfers in accordance with mandatory consumer law.
7. Right of withdrawal, returns and defects
Eligible consumers have the statutory rights described in our Returns & Right of Withdrawal policy. Personalised goods may be excluded from the right of withdrawal. Statutory rights for faulty, damaged or misdescribed goods remain unaffected.
8. Liability
Nothing in these terms excludes or limits liability where it cannot legally be excluded, including liability for intent, gross negligence, injury to life, body or health, product liability, fraud or a guarantee. For slight negligence involving an essential contractual duty, liability is limited to the foreseeable loss typical for the contract, to the extent legally permitted.
9. Intellectual property
Store content, product photography, artwork, branding and designs are protected by applicable intellectual property laws. Purchasing a product does not transfer rights to reproduce its design or use our content commercially.
10. Governing law and mandatory protection
These terms are governed by German law, excluding the UN Convention on Contracts for the International Sale of Goods, to the extent this choice is effective. If you are a consumer habitually resident elsewhere, this choice does not deprive you of mandatory protections that would apply without it. Mandatory rules on jurisdiction remain unaffected.
11. Consumer dispute resolution
We are not willing or obliged to participate in dispute-resolution proceedings before a German consumer arbitration board unless a mandatory rule requires otherwise.
12. Severability and changes
If a provision is invalid, the remaining provisions continue to apply to the extent permitted by law. The version presented before checkout applies to that order. We may update these terms prospectively for future orders.
